Maadhyam Unveils ADR Learning Series

Alternate Dispute Resolution (ADR) learning series Part 1 organised by Maadhyam International Council for Conflict resolution was inaugurated by Justice (Rtd) Mukta Gupta on 21st October.

Ms Puja Anand, Joint Secretary, Maadhyam, welcomed Justice Mukta Gupta and highlighted how Justice Gupta has not only been instrumental in delivering some remarkable judgements but also how she has been a beacon of light in the field of arbitration and mediation and will always be so in guiding the younger generation of professionals in the field of ADR.

Justice Mukta Gupta in her special Address, elaborated upon the nuances of Arbitration. In her elaborate address Justice Gupta touched upon almost every part of arbitration in detail keeping off to an engaging session.

Part-1 of the learning series focused on 'Enhancing Skills in Arbitration Pleading', It was conducted by senior professors and senior Advocates who gave the practical view of the different aspects of Arbitration. The session was attended by more than 50 participants from the field of law, engineering and Charted Accountancy.

Sr. Advocate and President-elect of Maadhyam, J P Sengh while opening the session endorsed Justice Mukta Gupta's remarks that learning is a never ending process and the ADR series would go a long way in training ADR professionals which is the need of the hour. J P Sengh also emphasised how, when the practices are shifting from Adhoc Arbitration to institutional arbitration it is important to acknowledge this shift sooner and such learning series would be required more.

Part-1 of the ADR learning series was divided in four sessions:

  1. Pleading for Appointment of Arbitrator:Domestic and International- By Prof. Sakshi Vijay and Advocate Rahul Narayan.
  2. Application for Interim Relief: Before, during and after Arbitral proceedings-By Prof. Akash Gupta, Advocate Dr. Amit George.
  3. Challenge to an Award and Enforceability of an International Award-By Prof Bhartendu and Sr. Advocate Dholakia.
  4. Assignments: Application/ Petition Drafting on Hypothetical Problem.
